Terms of Service

1. Licence Grant

Upon purchase of a licence, Jack Meadows grants you a non-exclusive, non-transferable, perpetual licence to install and use Ambience Friend on any macOS computers owned or controlled by you, solely for your personal or professional purposes. You may not run the Software on more than one computer simultaneously using the same licence.

2. Licence Restrictions

You may not:

• Copy, distribute, sublicense, sell, resell, or otherwise transfer the Software or your licence to any third party
• Reverse engineer, decompile, disassemble, or attempt to derive the source code of the Software
• Modify, adapt, or create derivative works based on the Software
• Remove or alter any proprietary notices, labels, or marks on the Software
• Use the Software in any unlawful manner or for any unlawful purpose

3. Ownership

The Software is licensed, not sold. Jack Meadows retains all intellectual property rights in and to the Software, including all copyrights, patents, trade secrets, trademarks, and other proprietary rights. These Terms do not grant you any rights to trademarks or service marks of Jack Meadows.

4. Payment

The Software is available for a one-off licence fee of £250 (two hundred and fifty pounds sterling), exclusive of any applicable taxes. Payment is processed securely through Lemon Squeezy. Your licence is activated upon confirmation of successful payment.

5. Updates and Support

Your licence entitles you to receive software updates released during the licence period at no additional charge, where such updates are made available by Jack Meadows. Jack Meadows reserves the right to determine what constitutes an update versus a new major version. Support is provided on a reasonable-endeavours basis via email.

6. Disclaimer of Warranties

The Software is provided "as is" and "as available", without warranty of any kind. To the fullest extent permitted by applicable law, Jack Meadows disclaims all warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. Jack Meadows does not warrant that the Software will be error-free, uninterrupted, or free of viruses or other harmful components.

7. Limitation of Liability

To the fullest extent permitted by applicable law, Jack Meadows shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of, or inability to use, the Software, even if advised of the possibility of such damages. In no event shall Jack Meadows' total liability to you exceed the amount paid by you for the Software.

Nothing in these Terms shall limit or exclude liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under applicable law.

8. Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

9. Changes to These Terms

Jack Meadows reserves the right to update these Terms at any time. Updated Terms will be posted on the Ambience Friend website. Continued use of the Software following notification of changes constitutes acceptance of the revised Terms.
